BN TYPE FOUNDRY

These Terms of Service (“Terms”) govern your access to and use of bnicks.com (the “Site”) and any products or services offered through the Site by BN Type Foundry, operated by Brandon Nickerson (“BN Type Foundry,” “we,” “us,” or “our”).
By visiting the Site, creating an account, making a purchase, downloading a product, or using any service offered through the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. ELIGIBILITY
You must be at least 18 years old or the age of legal majority where you live to make a purchase or enter into an agreement through the Site.
If you use the Site on behalf of a company, agency, studio, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. PRODUCTS AND SERVICES
BN Type Foundry offers products and services that may include:
- Individual font software.
- Font bundles.
- Free limited-time font releases.
- Font License Upgrades.
- Custom typeface design.
- Logo, branding, packaging, and graphic design services.
- Other digital products, resources, or services.
Product availability, descriptions, pricing, included files, and features may change at any time. We may modify or discontinue a product or service without prior notice.
3. FONT SOFTWARE AND LICENSING
All Font Software is licensed, not sold.
Your purchase grants only the usage rights described in the BN Type Foundry End User License Agreement (“EULA”), the applicable product page, your order confirmation, and any written custom license issued to you.
Every paid individual font or bundle includes a Standard Desktop License for up to 2 Users within the same legal entity unless different terms are expressly stated.
Free font releases include desktop rights for 1 User unless different terms accompany the download.
Additional Users, live website embedding, app or game embedding, server or production systems, and broadcast or video use require the applicable License Upgrade.
An Individual Font Upgrade covers one identified typeface. A Bundle Upgrade covers the fonts included in one identified BN Type Foundry bundle. License Upgrades add usage rights only and do not include the Font Software.
The EULA is incorporated into these Terms. If these Terms conflict with the EULA regarding Font Software, the EULA controls. A signed custom license controls only for the products and uses it expressly covers.
4. ORDERS
Submitting an order is an offer to purchase the selected product or service. We may accept, reject, limit, or cancel an order for reasons including:
- Pricing or product errors.
- Suspected fraud or unauthorized payment.
- Incorrect license selection.
- Product unavailability.
- Violation of these Terms or the EULA.
- Legal or regulatory requirements.
An order is accepted when payment is successfully processed and an order confirmation is issued.
If an accepted order is later canceled by us, we will refund the amount charged for the canceled item.
5. PRICES, PAYMENT, AND TAXES
Prices are displayed in the currency shown at checkout and may change without notice. Price changes do not affect completed purchases.
Payments are processed through Squarespace and its supported payment providers. BN Type Foundry does not directly store complete payment-card information.
You are responsible for applicable sales tax, use tax, VAT, duties, currency-conversion charges, and other governmental fees unless they are collected during checkout.
You agree to provide current, complete, and accurate billing and purchase information.
6. DIGITAL DELIVERY
Digital products are normally delivered through a download link or other electronic method after payment is completed.
Download links may expire. You are responsible for downloading your files promptly and maintaining secure backup copies.
If your files are missing, defective, or inaccessible, email contact@bnicks.com with your order number. We will provide reasonable assistance or replacement files for a valid purchase.
We do not guarantee permanent hosting or unlimited future access to past downloads.
7. RETURNS AND REFUNDS
Because font files, License Upgrades, and other digital products are delivered immediately and cannot be physically returned, all sales are final except where required by applicable law or expressly approved by BN Type Foundry in writing.
Purchasing the wrong product, font, bundle, or license does not automatically qualify for a refund.
Missing, defective, or inaccessible files will ordinarily be addressed through replacement or restored access rather than a refund.

8. ACCOUNTS
Some Site features may permit or require a customer account.
You are responsible for safeguarding your login information and for activity conducted through your account. Notify contact@bnicks.com promptly if you believe your account has been accessed without authorization.
We may suspend or terminate accounts that violate these Terms, the EULA, or applicable law.
9. CUSTOM DESIGN SERVICES
Custom typeface, branding, logo, packaging, and graphic design services may be governed by a separate proposal, estimate, statement of work, invoice, contract, or custom license.
Where those documents conflict with these Terms, the project-specific written agreement controls for that project.
Deposits, payment schedules, revisions, timelines, cancellations, ownership transfers, portfolio rights, and deliverables for custom services will be governed by the applicable written project agreement.
10. INTELLECTUAL PROPERTY
The Site and its contents are owned by or licensed to BN Type Foundry and are protected by copyright, trademark, and other intellectual-property laws.
Protected content includes:
- Font Software and font files.
- Typeface designs and glyph outlines.
- Logos and brand assets.
- Product names and descriptions.
- Specimen images and graphics.
- Photographs, illustrations, videos, and animations.
- Website design, layout, code, and written content.
Except for rights expressly granted under a purchased license, you may not copy, reproduce, modify, distribute, publish, sell, sublicense, scrape, repurpose, or commercially exploit Site content without written permission.
Purchasing Font Software does not transfer ownership of the Font Software or underlying typeface design.
11. PERMITTED SITE USE
You may use the Site for lawful personal or business purposes, including browsing products, testing fonts, managing purchases, reviewing license information, and contacting BN Type Foundry.
You may not:
- Use the Site for an unlawful or fraudulent purpose.
- Attempt to gain unauthorized access to the Site, accounts, servers, or systems.
- Interfere with the Site’s security or operation.
- Upload malware, malicious code, or harmful content.
- Scrape, harvest, or systematically extract Site content or data.
- Use automated systems to overload or disrupt the Site.
- Copy or reproduce product images, Font Software, or protected content without permission.
- Misrepresent your identity, affiliation, license rights, or purchasing authority.
- Circumvent checkout, security, download, or licensing controls.
12. TYPE TESTER
The Type Tester is provided for preview and evaluation before purchasing.
A Type Tester preview does not grant a license or authorize use of the Font Software. Font appearance may vary depending on browser, device, software, rendering environment, and available OpenType support.
Do not enter confidential, unlawful, or sensitive information into the Type Tester.
13. USER COMMUNICATIONS
When you submit a contact form, licensing request, support request, project inquiry, review, or other communication, you represent that the information is accurate and that you have the right to provide it.
We may use submitted information to respond, provide support, prepare quotes, process licenses, prevent fraud, and operate the business.
Do not submit confidential or proprietary information unless appropriate confidentiality terms are already in place.
14. THIRD-PARTY SERVICES
The Site is hosted by Squarespace and may rely on third-party services for payment processing, analytics, advertising measurement, file delivery, email, account management, and other functions.
Third-party services operate under their own terms and privacy policies. BN Type Foundry is not responsible for third-party websites, services, availability, security, or content.
Links to Instagram, Facebook, Pinterest, Dribbble, Google Drive, or other third-party sites are provided for convenience and do not constitute endorsement of all third-party content.
15. SITE ACCURACY
We attempt to provide accurate product, pricing, licensing, and availability information, but errors may occur.
We may correct typographical errors, inaccurate descriptions, incorrect prices, broken links, and other mistakes at any time.
Current licensing rights are governed by the applicable EULA, order confirmation, and written custom license rather than informal statements, archived pages, social posts, or third-party descriptions.
16. SITE AVAILABILITY
The Site and its features may occasionally be unavailable because of maintenance, technical problems, security concerns, service-provider interruptions, or circumstances beyond our control.
We do not guarantee uninterrupted, error-free, or permanent access to the Site, Type Tester, customer accounts, or download systems.
17. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Site, its content, and all products and services are provided “AS IS” and “AS AVAILABLE.”
BN Type Foundry disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, compatibility, and error-free operation.
Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, BN Type Foundry will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or replacement costs.
BN Type Foundry’s total aggregate liability arising from a product, service, or transaction will not exceed the amount you paid for the product, service, or transaction giving rise to the claim.
These limitations do not apply where prohibited by law.
19. INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify and hold harmless BN Type Foundry and Brandon Nickerson from third-party claims, liabilities, damages, judgments, and reasonable expenses arising from:
- Your breach of these Terms or the EULA.
- Your unlawful or unauthorized use of the Site or Font Software.
- Your infringement of another person’s rights.
- Content or information you submit through the Site.
20. SUSPENSION AND TERMINATION
We may suspend or terminate access to the Site, an account, download access, or services if you violate these Terms, the EULA, applicable law, or the rights of BN Type Foundry or another person.
Termination does not cancel payment obligations or provisions that are intended to survive, including intellectual-property ownership, restrictions, disclaimers, liability limitations, indemnification, and governing law.
21. GOVERNING LAW
These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles.
Any dispute arising from these Terms must be brought in the state or federal courts located in Indiana, and each party consents to their jurisdiction, except where applicable consumer law requires otherwise.
22. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in the Site, products, services, business practices, or legal requirements.
The updated version will be posted on this page with a revised “Last Updated” date. Changes apply prospectively from the date they are posted unless applicable law requires otherwise.
23. GENERAL TERMS
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
Failure to enforce a provision is not a waiver.
You may not assign your rights or obligations under these Terms without written permission. We may assign these Terms as part of a business transfer, reorganization, or sale of assets.
These Terms, the Privacy Policy, the EULA, the applicable order confirmation, and any signed project-specific agreement constitute the complete agreement governing your use of the Site and purchased products or services.
